# Privacy Policy Effective date: 2023/04/27 Welcome! This Privacy Policy explains how Cadstrom Inc. (**“Cadstrom”** or **“we”**), a company located at 2363 De Lorimier Avenue, Montréal (Québec) H2K 3X4 Canada, collects, uses, discloses and otherwise processes your information, including personal information, when you visit and use the Cadstrom website https://cadstrom.io/ and platform (collectively, the **“Platform”**), and when you use the services and tools available on the Platform (collectively, the **“Services”**). Please read this Privacy Policy carefully to understand our policies and practices regarding your information and how we will treat it. If you do not agree with our policies and practices, you should not use the Platform or the Services. By accessing or using the Platform and the Services, you agree to this Privacy Policy. This Privacy Policy may change from time to time. Your continued use of any of the Platform and the Services after we make changes is deemed to be acceptance of those changes, so please check the Privacy Policy periodically for updates. > In this Privacy Policy, the language in blue is provided for convenience only. It summarizes in plain language the key terms of this Privacy Policy to help our users understand better how we use and treat their information. We encourage you to read the full terms to have a complete understanding. The full terms govern the use of the Platform and prevail. ## Application > This Privacy Policy only applies to information we collect on or via the Platform and does not apply to information collected by third parties. This Privacy Policy applies to information we collect on or via the Platform or the Services, such as when you fill a form on the Platform, as well as in any email, text, and other electronic messages between you and the Platform. It does not apply to any information collected by or provided to us: - Offline or through any other means, including on any website operated by any third parties; - Pursuant to a separate written agreement other than our standard Terms of Service; or - By any third party, including through any application or content (including advertising) that may link to or be accessible from the Platform. ## Information we collect > We collect your information and the information shared or provided by users on the Platform in order to make the Platform work. In order to create an account, offer our Services, process your transactions, improve your experience with Cadstrom and the Platform and otherwise make our Platform and the Services work, Cadstrom must collect several types of information from and about users of the Platform, including information by which you may be personally identified, such as name, postal address, email address, telephone number, billing information, preference and settings or any other identifier by which you may be contacted online or offline (**“personal information”**); and other information that is about you but individually does not identify you, such as your viewing and usage data, the materials and comments you upload, post or share on the Platform and other generalized information that is not individually distinguishable; and/or about your internet connection, the equipment you use to access the Platform and usage details. ## How we collect your information > We collect information that you provide; that is automatically collected through cookies; and that is shared by third party. We generally collect information through the following means: - Directly from you when you provide it to us; - Automatically as you navigate through the Platform. Information collected automatically may include usage details, IP addresses, and information collected through cookies, web beacons, and other tracking technologies; - From third parties, for example, our business partners and payment processors. We may also require or collect your comments about your experience with using the Services and Platform. If you communicate with our service providers, such as the payment processors with do business with, such communication will be subject to their own terms and conditions, including in respect of privacy. ## Cookies > Cookies are used in to customize your experience on the Platform, but you may disable or refuse them. We use cookies to customize the Platform for returning visitors. These cookies remain on your computer or other electronic equipment and are automatically retrieved when you visit the Platform at a later time. These cookies contain only information about the type of customer and frequently visited pages. No other information is stored on cookies. You may disable cookies on your computer. Disabling cookies may affect user functionality, and visitors who have disabled cookie processing will not be able to use our personalized account management function. We have created certain mechanisms to provide you with control over your information on the Platform. Specifically, you can set your browser to refuse all or some browser cookies, or to alert you when cookies are being sent. If you disable or refuse cookies, please note that some parts of the Platform may then be inaccessible or not function properly. ## Web Logs > We maintain standard web log recording data about all visitors to the Platform. Cadstrom also maintains standard web logs that record data about all visitors to the Platform. These logs may contain: i) the Internet domain from which you access the Platform; ii) your IP address (your computer is automatically assigned an IP address when you surf the Internet; your IP address is either static or dynamic; a static IP address may be identifiable to you; a dynamic IP address is usually not identifiable to you); iii) the type of browser and operating system you use; iv) the date and time you visited this site; v) the pages you viewed on the Platform; and vi) the address of the website from which you accessed the Platform. ## Children > The Platform is not intended for children and we will not collect knowingly collect personal information from children under 16. The Platform is not intended for children, and we do not encourage children to provide us with personal information. We do not knowingly collect personal information from children under 16. However, children may access and use the Platform. If you are under 16, do not use or provide any information on the Platform or on or through any of its features, make any purchases through the Platform, use any of the interactive or public comment features of the Platform or provide any information about yourself to us, including your name, address, telephone number, email address, or any screen name or user name you may use. If we learn that we have collected personal information from a child under the age of 16 without verification of parental consent we will delete this information as quickly as possible. If you believe that we may hold information from a child under the age of 16, please notify us by e-mail at this address: support@cadstrom.io ## How Cadstrom may use and disclose my personal information > We may disclose your personal information to third parties, on a need-to-know basis, in connection with your access and use of the Platform and/or to comply with applicable laws. We use and share your personal information in order to make the Platform work. Your personal information will not be shared with third parties other than as explained in this Privacy Policy, except as required or authorized by law, or as ordered by a competent court. Cadstrom may share the information collected with our service providers we have contracted to assist us in providing our business needs, including the purposes outlined below. Personal information is disclosed to third parties, such as payment processors and other service providers, strictly on a need-to-know basis in connection with your access and use of the Platform and the Services and to comply with applicable laws. Personal information is communicated in a secure manner and only to the persons concerned. For example, your payment information is disclosed to our payment processors only to complete your transaction. Cadstrom may also use and share your personal information for the following purposes: - Presenting the Platform and its contents to you; - Providing you with information, products, or services that you request from us; - Fulfilling your orders or subscriptions; - Administering the Platform and Services; - Generating statistics, aggregating data, measuring the Platform’s activities, and detecting and preventing security threats; - Publishing your comments about another user’s project or about your experience with Cadstrom’s Services and your appreciation of the Platform; - Helping us develop and market our brand, Services, promotions and advertising; - Communicating with you about your subscription, including expiration and renewal notices; - Communicating with you about our new products, services, features and functionalities, and other news about Cadstrom; - Communicating with you about technical notices, updates, security alerts and support; - Responding to your requests, complaints, comments and questions; and - Other legitimate purposes that we identify to you from time-to-time. - Fulfilling any other purpose for which you provide it; - Carrying out our obligations and enforcing our rights arising from any contracts entered into between you and us, including for billing and collection (if applicable); - In any other way we may describe when you provide the information or for any other purpose with your consent. ## Storing and Sharing Information > Only those who need to access your personal information for legitimate purposes can do so. Only authorized personnel of Cadstrom and of our service providers who require this information to perform their duties will have access to the file containing your personal information. Your information will be held at our offices or on our servers or those of our service providers, which may be located in a country outside of Canada and thus will be subject to the laws of that jurisdiction. ## Data Retention > We keep your information only for as long as needed or otherwise permitted to fulfill our legal, accounting, or reporting requirements. We may anonymize and use your data but only for legitimate purposes. Except as otherwise permitted or required by applicable laws or regulations, we will only retain your personal information for as long as necessary to fulfill the purposes we collected it for, including for the purposes of satisfying any legal, accounting, or reporting requirements. Under some circumstances we may anonymize your personal information so that it can no longer be associated with you. We reserve the right to use such anonymous and de-identified data for any legitimate and serious business purpose without further notice to you or your consent. When your information is no longer necessary, it is destroyed. When destroying documents and data, we follow strict procedures and ensure that only authorized personnel has access to them. Cadstrom has internal policies and practices regarding personal information retention and destruction. For example: - Personal information is deleted when you update your information (such as changing your email address). - When you close your account, we will delete your information subject that we may retain your information up to 28 days from its deletion within the service, as required by law or any ongoing legal matters and in order for us to meet our reporting, compliance, and accounting requirements. - User content is generally retained until the project is explicitly deleted by the user, and not after it is deleted. Users may delete the project and its contents at any time. When the project is deleted all user content will be fully deleted within 28 days. - Users may upload new versions of their content. In this case, a retention period is applied to the old versions of the content depending on the users subscription tier. Previous versions are subject to deletion per the above. - Web logs and related data, including statistics and telemetry data may be retained indefinitely up to any legal limitations or requirements. ## Securing Information > Your information is secure. You may access or request to correct your personal information. All personal information will be safeguarded in a confidential manner in compliance with applicable federal and provincial (including Quebec) laws respecting the protection of personal information. Cadstrom employs reasonable administrative, technical and physical safeguards to protect your information from loss, theft and unauthorized access, use, disclosure, alteration, modification and destruction To the extent provided by these laws, you have the right to obtain access to your personal information and request that it be corrected if the personal information is inaccurate, out of date, incomplete or ambiguous, or if the collection, release or keeping of the information is not authorized by law. We ask that you help us by notifying us of any change in your personal information. In addition, if you notice any errors or inaccuracies, please let us know and we will make the necessary corrections. Any request for access to or correction of your personal information and any notice shall be directed bye-mail to support@cadstrom.io ## Data Security Measures > We use commercially reasonable security technologies to help protect your personal information from unauthorized access, use, or disclosure, but you are responsible for keeping your password confidential. The security of information is important to us. We use a variety of commercially reasonable security technologies to help protect your personal information from unauthorized access, use, or disclosure. However, we cannot guarantee 100% security and the use of such security technologies is not, and should not be considered to be, any type of guarantee or warranty by us that your personal information will not be accessed by third parties, or that we will use all available security technologies to prevent unauthorized access to, use, or disclosure of your personal information. While we use commercially reasonable efforts and measures (including physical, organizational and technological measures) to safeguard your personal information while it is being transmitted or used, we do not warrant that your personal information will be transmitted without unauthorized interception or modification or that your personal information will not be accessed or compromised by unauthorized third parties. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the Platform. We may permanently delete or destroy any and all personal information at any time as determined by us. The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of the Platform, you are responsible for keeping this password confidential. We ask you not to share your password with anyone. ## Ownership of information > We do not own user content available on the Platform and we are not responsible for it. User content is information, content and materials that users of the Platform have uploaded to, posted or shared on our Platform. It is stored both in its original form, and in some cases also converted to proprietary internal formats in whole or in part as needed by our system. We make no representation and give no warranty with respect to the content uploaded to, posted or shared on our Platform by users, including but not limited to ownership and non-infringement. Each user retains ownership of its content when uploaded to, posted or shared on our Platform. You may choose to license your content to users under the terms of your choice. We will make a good-faith effort to display any relevant license information and notices regarding user content on the Platform. Users may also upload to, post or share on our Platform content that is made available to them under license. **IMPORTANT: When uploading to, posting or sharing on our Platform content, you grant Cadstrom a license and right to display and process your user content until the content is deleted from the Platform, the whole as per our Terms of Service.** All user content is made publicly available to users with and without accounts unless explicitly marked as private, which is a paid feature under our subscription plans. User content is uploaded into **“Projects”**, and notice that the content is public or private is provided at project creation time. ## Update your information > Keep your information up to date. You can help Cadstrom maintain the accuracy of your information by notifying us when you change your address, phone number, email address, or other information. If at any time you wish to update your personal information then you may edit the information within your account at any time, if applicable. ## How to contact us > By email at support@cadstrom.io If you have any questions, concerns, or requests with respect to how we handle your information, this Privacy Policy or Cadstrom’s privacy practices, contact us by e-mail at support@cadstrom.io ## Changes to this Policy > We can update this policy from time to time, check it out regularly. It is our policy to post any changes we make to our Privacy Policy on this page. If we make material changes to how we treat our users’ personal information, we will notify you through a notice on the Platform. The date the Privacy Policy was last revised is identified at the top of the page. You are responsible for ensuring you have an up-to-date active and deliverable email address for you, and for periodically visiting the Platform and this Privacy Policy to check for any changes.
